Auction #2 Real Estate Terms - ONLINE Auction Terms - Real Estate: A 10% non-refundable earnest money escrow deposit is due to Phillips Brothers Auctions at signing of purchase contract (and/or signing via electronic signature) on FRIDAY, OCTOBER 9TH, 2026 by 4:00 p.m., with the balance due at closing on or within 30 days at closing. A 3% Online Buyer's Premium will be added to the high bid to create total contract price. Seller will pay for deed and a preliminary title search that has already been performed. Title insurance is available at the expense of the purchaser(s). Property taxes will be prorated to the date of closing. All other closing costs are to be paid by the purchaser. Possession given at closing. Building and property is all sold AS-IS. Property is being sold by deed description & existing boundaries. Auction is for the deed to the property as it is legally described, assessed, and recorded in Colbert County, Alabama, less existing right-of-way. Title to property will transfer by deed description and existing boundaries. All sales are final with no contingencies. No inspections have been made to the property. Property may be inspected prior to auction at bidder's expense. Phillips Brothers Auctions is agent for seller in this transaction and will assist the purchaser as a transaction facilitator in closing on the property.
Online Real Estate Bids: A 3% online buyer’s premium will be added to winning bid price to create total purchase price. Auction is set to close at the advertised date and time. Any bid placed within the last two minutes of ending time will extend the remaining bidding time back to two minutes remaining, and the clock will begin to count down again. This will continue until two minutes have passed with no bids being placed on the property, and the time remaining has expired.
Note: In the event of a technical error, Phillips Brothers Auctions may, if deemed necessary, extend the bidding on individual items.

Personal Property Terms - Online Personal Property Bids: A 5% online buyer’s premium will be added to winning bid price to create total purchase price. 10% sales tax in the town of Littleville will be applied.
You may pay for your purchases onsite at pickup BY APPOINTMENT on FRIDAY, OCTOBER 9TH (for Auction #2) between 9:00 A.M. and 4:00 P.M. All payments are due in full by 4:00 P.M. ON FRIDAY, OCTOBER 9TH. Any unpaid invoices after that time will automatically be charged to the buyer's card on file. Payment may be made by cash or check. Card payments may be made online or in person with additional 3.85% processing fee.
Pickup is on FRIDAY, OCTOBER 9TH for Auction #2. Please respond to your invoice email to give your estimated arrival time within the following times: 9 a.m. - 11 a.m., 11 a.m. - 1 p.m., & 1 p.m. - 4 p.m. Any pickup after October 9th is by auction company agreed appointment time with a 24 hour notice. ALL ITEMS ARE TO BE REMOVED BY 4:00 P.M. WEDNESDAY, OCTOBER 14TH.

This is a large online only auction. Items are offered through ONLINE AUCTION ONLY, and Auction begins to close at the advertised time stated. AUCTION #2 is a soft-close auction.

This will continue until no additional bids are placed and the time expires. NOTE: EXTENDED BIDDING ON AN ITEM DOES NOT AUTOMATICALLY EXTEND THE TIME REMAINING ON FOLLOWING LOTS. Each item has its own countdown clock, be sure to remain aware of the time remaining on your items of interest.
You may choose to place a "MAX-BID" on an item and the online system will place bids for you up to your highest bid offer. While online bidding is still live on an item, you also may increase your MAX-BID if you wish, or if you have been outbid you may place a new bid or MAX-BID.
